Description

Printed prize appeal from the High Court of Admiralty.

Captured ship: Concordia (master Johann Joachim Kreplien).

History: a Swedish vessel, bound from Aalborg to Bordeaux, laden with salted beef; taken on 24 January 1779 by the privateer Active (William Watson commanding) and brought into Falmouth.

Appellant: George Wolff on behalf of Christen Ryberg and others merchants of Aalborg.

Respondent: The captor.

Bound printed appeal with manuscript decree of 15 April 1780.

Folios 121-148v, comprising:-

  • folios 121-122v: case on behalf of the appellant;
  • folios 123-134v: appendix to the appellants' case;
  • folios 135-136v: case on behalf of the captor and respondent;
  • folios 137-148v: appendix to the respondents' case.

Session of Saturday 15 April 1780, in the Council Chamber, Whitehall: sentence recorded in manuscript on folio 136:-

  • Present: Lord Chancellor; Lord President; Lord Privy Seal; Earl of Denbigh; Earl of Marchmont; Lord George Germain; Lord Stormont; Viscount Howe.
  • Concordia, Johan Joachim Kreplien master. Townley. Jenner. For further informations and sentence.
  • "The Lords having heard the proofs and counsel on both sides by their interlocutory decree affirmed the sentence of the judge below and decreed the cause to be remitted."
