Description

Printed prize appeal from the High Court of Admiralty.

Captured ship: Hertogin de la Vauguyon (master Klaas Cornelis de Jongh).

History: a Dutch vessel, bound from Port Maurice, Genoa to Le Havre, laden with olive oil, lemons; taken on 21 October 1778 by the privateer Britannia (James Furze commanding, now deceased) and brought into Bristol.

Appellant: The captor (owners, and master, now deceased).

Respondent: The master, for the owners, merchants of Amsterdam.

Bound printed appeal with manuscript decree of 10 April 1780.

Folios 109-120v, comprising:-

  • folios 109-110v: case on behalf of the appellant;
  • folios 111-114v: appendix to the appellants' case;
  • folios 115-116v: case on behalf of the respondent;
  • folios 117-120v: appendix to the respondents' case.

Session of Monday 10 April 1780, in the Council Chamber, Whitehall: sentence recorded in manuscript on folio 116:-

  • Present: Lord Chancellor; Lord President; Earl of Marchmont; Lord Hillsborough; Earl of Clarendon; Lord George Germain; Lord Stormont; Viscount Howe.
  • The Hertogin de la Vauguyon, Klaus Cornelis master. Altham. Crespigny. For sentence on the second assignation and informations.
  • "The Lords having heard the proofs and counsel on both sides by their interlocutory decree affirmed the sentence of the judge below and decreed the cause to be remitted and also condemned the Appellant in the costs of the appeal."
