Description

Printed prize appeal from the High Court of Admiralty.

Captured ship: St Johannes and Elizabeth (master Hans Peter Petersen).

History: a Danish vessel, bound from Randers to Bordeaux, laden with beef, pork; taken on 20 April 1779 by the privateer Salisbury (John Chandler commanding) and brought into Falmouth.

Appellant: The master.

Respondent: The captor.

Bound printed appeal with manuscript decree of 6 April 1780.

Folios 93-102v, comprising:-

  • folios 93-94v: case on behalf of the appellant;
  • folios 95-98v: appendix to the appellants' case;
  • folios 99-100v: case on behalf of the respondent;
  • folios 101-102v: appendix to the respondents' case.

Session of Saturday 6 April 1780, in the Council Chamber, Whitehall: sentence recorded in manuscript on folio 100:-

  • Present: Lord Chancellor; Lord President; Lord Privy Seal; Earl of Denbigh; Earl of Marchmont; Earl of Hillsborough; Earl of Clarendon; Viscount Stormont; Viscount Howe; Sir Thomas Parker.
  • St Johannes and Elizabeth, Peter Petersen master. Crickitt. Fountaine. For sentence on the second assignation and information.
  • "The Lords having heard the counsel on both sides and the captor having given up all claim to the prize in the court below and thereby admitted the cargo to be innocent their Lordships by their interlocutory decree condemned the captor in the costs of suit to the time the cargo was restored in the court below."
