Description

Printed prize appeal from the High Court of Admiralty.

Captured ship: Enigheten (master Hans Severin Crup).

History: a Swedish vessel, bound from Nantes to Genoa, laden with saltpetre, tobacco; taken on 30 December 1778 by the privateer Old England (James Todd commanding) and brought into Bristol.

Appellant: Dominick Candid Boyer, Sardinian consul and William Herries, merchant of London, for the cargo.

Respondent: The captor.

Bound printed appeal with manuscript decree of 18 March 1780.

Folios 71-92v, comprising:-

  • folios 71-72v: case on behalf of the appellant;
  • folios 73-78v: appendix to the appellants' case;
  • folios 79-80v: case of William Herries, one of the appellants;
  • folios 81-84v: appendix to the case of William Herries;
  • folios 85-86v: case on behalf of the respondent;
  • folios 87-92v: appendix to the respondents' case.

Session of Saturday 18 March 1780, in the Council Chamber, Whitehall: sentence recorded in manuscript on folio 86v:-

  • Present: Henry, Earl Bathurst, Lord President of the Council; Earl of Denbigh; Earl of Marchmont; Earl of Hillsborough; Earl of Clarendon; Viscount Stormount; Lord Amherst; Sir Thomas Parker.
  • Enigheten, Hans Severin Crup master. For sentence on the second assignation and information.
  • "The Lords having heard the proofs and counsel on both sides by their interlocutory decree reversed the decree of the judge below condemning the goods claimed by Dominick Candid Boyer esq Heseltine's client and by William Herries Crickitt's client and by consent decreed the same to be now restored or the value thereof to be paid to the Claimants for the use of the proprietors without going into further prook of property and their Lordships condemned the Respondent in the costs of the appeal."
