Description

Printed prize appeal from the Vice-Admiralty Court of Nova Scotia.

Captured ship: Boston Packet (master James Shepherd).

History: a British vessel, bound from Salem, Massachusetts to Halifax, Nova Scotia, laden with rice, iron, hemp, Russian sailcloth, linen; taken on 12 April 1776 in Halifax harbour by HMS Savage (Hugh Bromedge commanding) and brought into Halifax.

Appellant: The master and Nathaniel Byfield Lyde and William Dennier, owners.

Respondent: The captor and Philip Crespigny, HMPG.

Bound printed appeal with manuscript decree of 18 March 1780.

Folios 40-51v, comprising:-

  • folios 40-41v: case on behalf of the appellant;
  • folios 42-45v: appendix to the appellants' case;
  • folios 46-47v: case on behalf of the respondent;
  • folios 48-50v: appendix to the respondents' case.

Session of Saturday 18 March 1780, in the Council Chamber, Whitehall: sentence recorded in manuscript on folio 47:-

  • Present: Henry, Earl Bathurst, Lord President of the Council; Earl of Denbigh; Earl of Marchmont; Earl of Hillsborough; Earl of Clarendon; Viscount Stormont; Lord Amherst; Sir Thomas Parker.
  • Boston Packet, James Shepherd master. Grene. Crespigny. For sentence on the second assignation and information.
  • "The Lords having heard the proofs and counsel on both sides by their interlocutory decree reversed the sentence of the judge below and decreed the ship and cargo to be restored or the value thereof to be paid to the Claimant and Appellant and condemned the Respondent in costs from the time of the sentence in the court below."
