Description

Printed prize appeal from the Vice-Admiralty Court of Nova Scotia.

Captured ship: Nicholas (master Nathaniel Atkins).

History: a British vessel, bound from Salem, Massachusetts to Halifax, Nova Scotia, laden with rice, iron, hemp, Russian sailcloth, linen; taken on 16 January 1776 by HMS Savage (Hugh Bromedge commanding) and brought into Halifax.

Appellant: The master, John White (late supercargo) and Thomas Boylston owner of the ship and cargo.

Respondent: The captor and Philip Crespigny, HMPG.

Bound printed appeal with manuscript decree of 18 March 1780.

Folios 28-39v, comprising:-

  • folios 28-29v: case on behalf of the appellant;
  • folios 30-33v: appendix to the appellants' case;
  • folios 34-35v: case on behalf of the respondent;
  • folios 36-39v: appendix to the respondents' case.

Session of Saturday 18 March 1780, in the Council Chamber, Whitehall: sentence recorded in manuscript on folio 35:-

  • Present: Henry, Earl Bathurst, Lord President of the Council; Earl of Denbigh; Earl of Marchmont; Earl of Hillsborough; Earl of Clarendon; Viscount Stormont; Lord Amherst; Sir Thomas Parker.
  • The Nicholas, Nathaniel Atkins master. Grene. Crespigny. For sentence on the second assignation and information.
  • "The Lords having heard the proofs and counsel on both sides by their interlocutory decree reversed the sentence of the Judge below and decreed the ship and cargo to be restored to the value thereof to be paid to the Claimant and condemned the Respondent in costs from the time of the sentence of the court below."
