Description

Folios 175-176: Enclosure with folios 173-229: James Robinson, Officiating Judge Advocat. Court of Enquiry, Sydney House, March 28 1803. Officials James Colnell, HMS Glatton, President, Philip Gidley, HMS Buffalo, William Kent 2nd Commander, HMS Buffalo. Alexander Forsyth went to the gunroom and saw and saw a Corporal of the Marines Patrick Archibald who said he was struck by a bugger. Robert Rawlins Midshipman stated that on 22 November 1802 heard a riotous noise and went to the gunroom and heard Archibald shouting '‘Blackguard, bugger and scoundrel’'. On being questioned Archibald said he had nothing to say.

Officials James Colnell, HMS Glatton, President, Philip Gidley, HMS Buffalo, William Kent 2nd Commander, HMS Buffalo. The charges between Lieutenant Forsyth and Lieutenant Ingles were read out and Ralph Stoll Master of HMS Bufflalo was called as a witness as to the homosexual acts (described) between the Cape of Good Hope and Rio de Janeiro mentioning Midshipman Ellison, Major Johnston, Forsyth and Ingles. Forsyth ordered the Sergeant at Arms to arrest Ingles for buggery in the locker room, cabins and on the quarter deck. Henry Gerault Seaman was called as a witness. He talks about ‘the girls in the gunroom’ and how Forsyth said had been ruined forever. Lieutenant Ingles states that Forsyth was not drunk.

Mr Lloyd, Surgeon'’s mate was called as a witness and repeated conversations witnessed. Lieutenant Ingles stated that Ellison had slept in his cabin because he was unwell. Elizabeth Archibald was called as a witness who said she had been called by Mrs Nann the Serjeant’'s wife to see Ingles in bed with Ellison through the cabin window. George Armstrong called who stated similar but said that Ellison'’s bed was wet. Captain Kent stated that Ingles’ partiality for Ellison was improper. The court concluded that Ingles and Forsyth be sent to England under arrest along with Archibald, Stott, Gerault, Lloyd, Armstrong Rawlins and Mrs Archibald.

Folios 182-183: Enclosure with folios 175-176: Lieutenant Ingles’ justification He emphatically states his innocence and horror at the charges which are ‘ a 1000 times worse than death and ranked him with the vilest of men’. He hopes his unblemished reputation will prove him innocent. He cannot apologise as his reputation has been so damaged. Folios184-185: Enclosure with folios 175-176: Copy of folio 174-175. Folios 185-186: Enclosure with folios 175-176: Charles Ingles, HMS Buffalo, to Gidley King, November 23 1802. Describes the expressions used by Lieutenant Forsyth and Mr Stott in the Gunroom and called the Sergeant of Marines to arrest him. He requests advice. Folios187-188: Enclosure with folios 175-176: C.Ingles, HMS Buffalo, Port Jackson, New South Wales. To P.G.King. Wants to report the expressions used by Pat Archibald Marine. Hearing a noise in the Marine's’ berth he sent for Sergeant Vann but he was drunk and shouted more abuse so he struck him on the face to quieten him and then shackled him. When he returned to the gun room, Mr Rawlins informed him of what had happened. It was such an attack on his character, he demands a Courts Martial to exonerate his conduct and for charges to be brought against Archibald. Folio 189: Enclosure with folios 175-176: [Brastaff] Attestation. Reports of a commotion in the Gun room and horrid mutinous expression. Folio190: Enclosure with folios 175-176: D Rawlins. At 3 o'’clock on November 22 1802, he heard Archibald abusing someone. Folio 190a Enclosure with folios 175-176: R.Lloyd, Surgeon’'s Mate, HMS Buffalo. On November 22 1802. He heard Lieutenant Forsyth say in the presence of two women that he was going to put Lieutenant Ingles under arrest. Stott, Master, objected to this. Folio 191: Enclosure with folios 175-176: Henry Galbraith, HMS Buffalo. Acting Lieutenant Forsyth ordered him to call the Serjeant of Marines. He heard Lieutenant Forsyth say in the presence of two women that he was going to put Lieutenant Ingles under arrest. Stott objected to this.
