Folio: 194v. County of Yorkshire. Responses given to the articles concerning the Earl Marshal for the bailiwick of the forest of Pikering [Pickering]: As to the fact that the earl seeks restoration of the issues of his bailiwick from the time when his bailiwick was in Edmund's hands, by consideration of the justices, until the redelivery of the same by order of the king, the bailiff answers that all those issues are allowed to the earl in his farm, which he owes for that bailiwick.
As to the fact that the earl seeks to have his iron forge in his wood of Levesham [Levisham] and his mine in peace, it is surprising that he seeks such, because up to this point he has found none of the ministers of Edmund, who has disturbed him or disquieted him upon this, nor will he be disturbed while he wants to faithfully pay the yearly farm thereupon due.
As to the fact that the earl made it known to Edmund that the bailiff of Pik' [Pickering] and foresters of the same caused there to be seized the bailiwick of the earl into Edmund's hands from his own authority and that of the said bailiiffs and not from the order of the justices, the bailiff answers for himself and the foresters that the bailwick was not seized from his own authority but from the order of the justices. And concerning this he calls the justices to warrant, and it evidently appeared that the earl in his own proper person came before the justices at Pickering to replevy his bailwiick, and he did not obtain permission until he had gained the writ of the king about having the bailiwick again with all the issues.
The earl seeks from Edmund that he might have a letter of the same to his bailiffs of Pickering about having the bailiwick of the earl in peace, in the state in which H [Hugh] Bigod, father of the earl, had it in the forest of Pickering. That the earl handed over for his bailiwick 63s 4d per annum to Edmund, the earl seeks that he has in peace what the said H, his father and his other ancestors had in their said bailiwick, to be levied at the farm of Edmund, namely in Scalleby [Scalby] escapes, windfallen wood, bracken, cart-toll and honey. And if Edmund gives or sells or takes to his own use an oak or other tree, he seeks as his right the loppings, bark and croppings and seeks there dry wood felled to the ground and the farm of collecting nuts.
The earl seeks as his right, pertaining to his bailiwick in the aforesaid form, namely in the woods of Langedon and Alynetoftes, the herbage, windfallen, dry and dead wood without waste and destruction, and also honey and the farm of collecting nuts and 'rere-pannage', and also the loppings, bark and croppings, as above.
About the aforesaid matters the earl complains that Edmund's bailiffs sold wood in the hay of Scalleby [Scalby] and the wood of Alylinetoftes now throughout four continuous years, and did not permit the earl's bailiffs to have their right of loppings, bark and croppings to the serious damage of the earl and unjustly. Wherefore he seeks remedy from Edmund.
