Place or subject: Whereas a certain fine had been levied in the court of Edward, formerly king of England, the king's grandfather, before John de Metyngham and his fellow justices of the Bench at York in the octave of Trinity 29 Edw I, between Adam de Waleton of Hole [Hoole], querent, and Adam, son of Warin de Waleton [Walton], deforciant, concerning the manor of Waleton [Ulnes Walton], 30 acres of land in Leylande [Leyland], 30s of rent in Kelgrimesargh [Kellamergh], and a moiety of the manors of Ecleston [Eccleston], Heskyn [Heskin] and Leylond [Leyland] with appurtenances, whereupon a plea of covenant was summoned between them in the same court, by which fine the said Adam de Waleton of Hole [Hoole] acknowledged the said tenements to be the right of the same Adam, son of Warin of Waleton. And for this fine the same Adam, son of Warin, granted to the said Adam de Waleton of Hole [Hoole] the said tenements, and he handed them over to him in the same court. To hold to the same Adam de Walton of Hole [Hoole] and the heirs of his body begotten of the chief lords of that fee by the services, which pertain to those tenements forever. And if it happens the said Adam de Waleton was to die without heirs in tail, then after his decease the lands were to remain entirely to Adam de Waleton of Mitton in tail. And if Adam de Waleton of Mitton were to die without heirs in tail, then after his decease the said lands were to remain to William de Waleton in tail, with further remainder after his death to Margery de Waleton in tail, and after her death without heirs in tail, then they are to revert to the said Adam, son of Warin de Waleton, and his heirs quietly. On the part of the said William de Waleton, the king has heard that the said Adam de Waleton of Hole [Hoole] has died without heirs in tail, as has Adam de Waleton of Mitton, by which the said tenements after their deaths ought to remain the same William de Waleton by form of the said fine. William, son of Robert de Radeclyve [Radcliffe], and Katherine, his wife, now hold the said manor of Waleton [Ulnes Walton], 30 acres of land in Leylande [Leyland], 30s of rent in Kelgrimesargh [Kellamergh] and a moiety of the manors of Eccleston, Heskyn [Heskin] and Laylond [Leyland], except for one messuage, 23 acres of land from the same moiety of the manor of Leyland. And Nicholas son of Henry, son of Robert atte Tonesende and Elizabeth, sister of the same Nicholas, now hold the same messuage and the same 23 acres of land from the same moiety of Leylonde [Leyland], and they unjustly deforce the same William de Waleton contrary to the tenor of the said fine.
