Description

Folios: 77v-78. County of Lancaster. Grant.

First party: Henry [Henry of Lancaster], earl of Lancaster and Leicester, steward of England.

Second party: The prior and canons of Burscogh [Burscough].

Place or subject: Whereas Edmund, son of Henry III, the king's father, had lately granted to the prior and canons of Burscogh [Burscough] a free market in his manor of Ormeschirche [Ormskirk] in the vill of Lathum [Lathom] and fairs, as is more fully contained in the king's charter, paying for this to the king's father one mark of silver at the feast of the Nativity of the Blessed Virgin Mary in the name of stallage and toll, which the king's father used to take in the said vill. And by virtue of the said grant the said prior and canons claimed that all the fines of the breaking of the assize of bread and ale both on days of the market and fairs and also every single day, week and year were due to them and they were being disturbed unduly by the king's ministers. The said Henry grants that the said prior and canons and their successors are to have and hold forever a free market and fairs in their said manor according to the grant of the king's father, and also the assize of bread and ale and fines issuing therefrom from all their tenants and residents in the said manor both every single day, week, year and also on days of markets and fairs, which could befall in the said manor in the future, free and quit from all disturbance, exaction or demand by reason of the said assize and without impediment of the said earl or his heirs or bailiffs, paying theruepon yearly to the earl and his heirs at Derby 6s 8d sterling at the feast of the Nativity of the Blessed Virgin Mary beyond the said mark, charged before for things which could pertain to the earl or his heirs by reason of the said assize, always saving the said yearly rent of one mark to the earl and his heirs.
