Description

Prisoner name: Michael Leary, railway labourer, and Thomas Martin, aged 24, mason and stone squarer.

Court and Date of Trial: Glamorgan Summer Assizes, Cardiff, July 1848.

Crime: Martin - Murder of John Williams near Swansea on 8 May 1848.

Leary - Aiding and abetting Martin in murder.

Initial sentence: Martin - Death, commuted to transportation for life.

Leary - Death, commuted to seven years transportation.

Gaoler's Report: Martin - Portland, conduct good.

Outcome: Leary - Free pardon, 3 January 1849.

Martin - Conditional pardon on quitting United Kingdom, 26 October 1859.

Petitions and letters: Four certificates testifying to Martin's good character.

Letter from governor of Swansea gaol reporting date of execution of Martin at Cardiff.

Reports from judge recommending mitigation on grounds of doubt of guilt of Martin, with notes of evidence, letter from High Sheriff and statement of prisoner Leary.

Two letters from C Vachell of Cardiff informing of petition and transmitting s tatements of bad character of witness Patrick Leary, railway labourer, the prisoner's brother, with certificate from six inhabitants of Swansea, and four letters from individuals, stating that P Leary is a liar.

Two petitions, one from inhabitants of Cardiff and district (signatures detached), and one from 31 inhabitants of Swansea, on behalf of both prisoners, pleading opposition to death penalty, uncorroborated evidence of Patrick Leary and previous good character of Martin, with covering letter.

Certificate from governor of Swansea House of Correction testifying to prisoners' good conduct.

Two letters from governor of Cardiff prison acknowledging respite of sentence of death on Martin.

Petition from Evan Jones, editor of The Principality newspaper, Cardiff, pleading insufficient and unsupported evidence against both prisoners.

Report from visiting justices of Cardiff gaol on good conduct of Leary.

Report from judge recommending pardon for Leary on grounds of insufficient evidence.

Three reports from Thomas W Booker, High Sheriff of Glamorganshire, the first reporting overcrowding and dysentery in Cardiff gaol and good conduct of Leary and Martin, the others pleading innocence as murder committed by 'the villain, Patrick Leary' and that they not be transported; first report with copy minutes recommending transfer of named prisoners.
