Description

Captured ship: Peter of Waterford or London (master John Gough).

History: an English or Irish Jacobite merchant ship (50 tons, owner Peter Nagle) bound from Charron to London, laden with brandy, and paper; taken on 5/15 June 1689 off Deadmans Point by HMS Rupert Prize (Francis Wheeler commanding), and brought into Falmouth. The ship was previously rented out to carry French military supplies from Rouen to La Rochelle.

Court Papers numbered CP 1-CP 92:

  • [CP 1]: interrogatories;
  • [CP 2-CP 5]: three sets of claims to the ship and cargo on behalf of merchants in London and Great Yarmouth, with an affidavit by the captors agreeing that the ship be moved to London;
  • [CP 6-CP 31]: the first allegation with annexed exhibits, accounts, commercial letters in French and Engish, bills of lading;
  • [CP 32]: one examination;
  • [CP 33-CP 59]: the second allegation with annexed exhibits, bills of lading, commercial letters in French, accounts, factures, docket;
  • [CP 60-CP 75]: the third allegation with annexed exhibits, accounts, commercial letters in French and Engish, bills of lading, factures
  • [CP 76]: claim to the cargo on behalf of a merchant in London;
  • [CP 77-CP 81]: the fourth allegation with four sets of interrogatories;
  • [CP 82-CP 87]: the fifth allegation with a commission, interrogatories, proxy, substitution, and a charterparty;
  • [CP 88-CP 92]: attestation with a note relating to the ship's lading, three dockets for the ship's papers.

Ship’s Papers numbered SP 1-SP 10, certificates, petition, ship's passes.

The personal archive of John Gough, numbered A 1-A 25:

  • A1-A 5: commercial and personal letters addressed to Gough, one discussing the his favour with James II, with one further letter addressed to M. Buisel at Poperingué;
  • A 6-A 10: letters concerning the ship's previous and current voyage, one noting the necessity of returning to London before the imposition of trading prohibitions;
  • A 11-A 14: letters from the owner, Peter Nagle, with one by Gough;
  • A 15-A 16: letters from Guadiat & Diharee;
  • A 17: a declaration by Gough given at La Rochelle listing French and Irish merchants concerned in the ship;
  • A 18-A 25: further letters concerning the ship's voyage, certificates, and receipts.

[Decision: ship and cargo condemned, 14 January 1690].
