'The [malt tax] riot[s] in Scotland might be made High Treason, but that prosecutiion must be attended with the trouble, expense and delay of a Commission of Oyer and Terminer, and the hazard of a Glasgow jury; whereas all other crimes may be tried at Edinburgh at any time, and by an Edinburgh jury; for it is not there as with us, who, if I mistake not, when we try by cause before the King's Bench must have a jury of the county where the fact was committed'.
