Folio 115. The case of Charles Deacon [an ensign in the Manchester Regiment] one of the prisoners in the new gaol at Southwark convicted of high treason at St Margarets Hill [3 June 1746]. Whereas his two elder brothers enlisted with the Young Pretender at Manchester, the petitioner only joining them to run away from school; all being captured at the fall of Carlisle [December 30 1745]. While his middle brother had died of a fever on the march southwards, and eldest executed at Kennington Common, the jury thought the prisoner's case 'so compassionate' that they recommended him to the favour of the court [to be transported] as he was under fifteen.
