To: Messrs Radcliffe and Layton, Clerks to the Local Board of West Derby [Lancashire].
From: The Local Government Act Office.
Subject Matter: Draft letter in reply to a letter of 1 August 1868 regarding two cases of Asiatic cholera in West Derby.
It is advised that, in the absence of an Order in Council, neither the local Board of Guardians nor any other authority can exercise the functions referred to in Section 6 of the Diseases Prevention Act 1855. It is stated that all that the Local Board can do is exercise their powers as a Local Board and a nuisance authority to prevent and remove any local causes of epidemic cholera. Certain sections of the Sanitary Act 1866, it is pointed out, give the Local Board a number of useful powers in the event of a cholera outbreak, including the provision of temporary hospital accommodation.
