Folios 458-459.
To: The Local Government Act Office.
From: Messrs Radcliffe and Layton, solicitors to the Local Board of West Derby, 13 Hackins Hey, Liverpool [Lancashire].
Subject Matter: Letter regarding a proposed purchase of land in order to widen Prescot Road, a turnpike road in the West Derby District. He explains that the land abutting the road belongs to the Corporation of Liverpool and will cost about £163. They state that they have advised the Local Board that the purchase would be illegal and it has been postponed. They submit that, since the road is not a public highway, any land added to it would pass to the turnpike trustees and the Local Board would therefore be spending public money for the benefit of the trustees.
They ask for an opinion with regard to Section 73 of the Public Health Act 1848 and Section 36 of the Local Government Act 1858.
