Description

Short title: Hopkinson and others v Wigley.

Plaintiffs: Anthony Hopkinson and others.

Defendants: Richard Wigley.

Documents: depositions concerning the right of common on Wirksworth moor, Wirksworth, Derbyshire.

Taken 1st February, 6 James I.

Deponents for plaintiffs: Edward Ragg of Bonsall, miner, aged around 75; James Woods of Bonsall, miner, aged around 58; Thomas Vallerie of Wirksworth, husbandman, aged around 55; John Poyser of Wirksworth, miner, aged 3 score and 6 [66 years], deposed that there was an attempt to enclose part of Wirksworth moor called Wigwall Greene, an act that would be of 'great annoyance and troble' [great annoyance and trouble] to the inhabitants of Wirksworth.

Deponents for defendants: Anthony Cadman of Wirksworth, yeoman, aged around 58, deposed that Wigley has enclosed 6 acres of land during which time the tenants did not allow their sheep onto the land. The defendant has appeared before the court leet prior regarding the enclosure and pains made upon him to make the land open; William Wild of Whatstandwell, yeoman, aged 70; Anthony Flint of Matlock, yeoman, aged 84; Isabel Beighton of Wirksworth, aged 75; Hugh Wood of Wirksworth, yeoman, aged 75; WIlliam Wall of Wirksworth, miner aged 78; Edward Allen of Wrigwall, yeoman, aged 67; Thomas Miller of Selston, Nottinghamshire, husbandman, aged around 90; John Wood of Heanor, yeoman, aged 4 score and 10 [90 years].
