Subject Matter: Letter enquiring as to 130 claims received purporting to be from landowners, which were delivered by two parties, and not the landowners themselves. Welsby explains that they seem to be signed by the same person and not the landowners themselves, and that according to the Act, it intends the owners to deliver the required notice in person as a guarantee against the interference of third parties, and that the notice delivered by a third party is not in compliance with the Act, which directs that the owner is entitled to vote if he has delivered to the clerk, and he refers to section 23. He asks whether he is justified in treated the delivered notices as void, or rather leaving the parties to apply for voting papers in person, under section 26 of the Act. He refers to several of the notices being very indefinite, and he therefore unable to state satisfactorily what number of votes each person is entitled to. He asks for advice on this matter.
