To: The Local Government Act Office.
From: J Leacock, Oakhill, Ryde, Isle of Wight.
Subject Matter: Letter advising that there is a ditch, or rather a 'stream', which is the exit of all the water, etc., of Springvale. Leacock explains that the Coastguard authorities have built four cottages at Springvale for their men, and that the stream in question passes through the middle of their premises. All the privies, etc., are said to discharge into it, 'thereby creating an intolerable nuisance'. Leacock further explains that as there has been a death this week by diphtheria in one of the cottages, he applied to the Solicitor and Clerk to the Special Drainage District for his advice as to an inspection of the cottage premises. He encloses a copy of the Clerk's reply, by which it appears that he is of the opinion that such duties rest with the Board of Guardians. Leacock calls attention to an apparent difficulty in Section 5 of the Sanitary Act 1868 and submits that unless some legal decision or a fresh explanatory act is obtained, nuisances will not be abated under the divided and uncertain duties of the Guardians and the Sewer Authorities.
