Following the UK/EC Assessors' Report, on 17 December 1998, the Deputy Prime Minister, The Rt Hon John Prescott MP announced that there was to be a full re-opening of the Formal Investigation and that this was to be held in the High Court under section 269(1) of the Merchant Shipping Act 1995.

The hearing commenced on 5 April 2000 and lasted for 54 days, concluding on 26 July 2000.
