To: John Stephens, Bo'ness [West Lothian, Scotland].
From: The General Board of Health.
Subject Matter: Draft letter acknowledging receipt of a letter dated 6 January 1849, enquiring whether a Parochial Board can take the performance of operations required by law out of the hands of the Local Trustees of Bo'ness, and whether they can recover the expense of performing such operations from the Trustees. Stephens is advised that the provisions of the Nuisances Act and the regulations of the General Board require that in cases of neglect or failure of local bodies to remove nuisances and effect requisite cleansing operations, the Parochial Boards are authorised and required to execute the works so neglected and to defray the expenses from the Poor Rates. With regard to the recovery of these expenses, it is explained that the Parochial Board must be guided by the Board of Supervision, as the Nuisances Act does not appear to make any provision on the point.
