Description

Folio 87-88. Petition for mercy from [Jacobite] prisoner at York Castle [Yorkshire], Archibald Kennedy, formerly a jeweller's apprentice of Edinburgh, to Lord Chief Justice Burnett, noting the latter's relationship to the Caple family to which 'the petitioner is nearly allied'. Mentions Ronald Crofford, and Mr Lockhart. Enclosing:

Folio 89. Affidavit of Alexander Shaw, attorney at law, of Edinburgh, in support of Archibald Kennedy son of William Kennedy of Dalgain [Sorn, Ayrshire] and of Helen Smith daughter of John Smith of Alderston [East Lothian?], apprentice jeweller and goldsmith to James Ker, or Kerr. He confirms the Kennedy family's presbyterian faith, and says that Archibald was 'inveigled' into joining the Jacobites through idleness occasioned by business closure in Edinburgh during the terror of the Highlanders'. Sworn before John Philp. Dated at Edinburgh.

Folio 90. Affidavit of Robert Hamilton, minister of Edinburgh, in Kennedy's favour, confirming the content of the affidavit sworn by James Ker. Endorsed by Alexander Shaw, and sworn before John Philp.

Folio 91. Affidavit of John Wilson, 'Turner, Citizen, Burgess & Gild Brother' of Edinburgh, confirming Kennedy's presbyterian faith, and his belief that he wanted to quit the rebels. Sworn before John Philp. Dated at Edinburgh.

Folio 92. Affidavit of James Ker, 'Jeweller burgess and Gild Brother of Edinburgh and late Deacon of the Incorporation of Goldsmiths', commander of a company of Gentlemen volunteers. Refers to the Presbyterian faith of the Kennedy family, being taken into the care of 'George Herriot's hospital' when orphaned, and his initial hope to join the volunteers to fight for the King. Sworn before John Philp. Dated at Edinburgh.

Folio 93. Affidavits confirming the contents of James Ker's statement, sworn by four ministers: George Logan; John Glen; Jo [John] Hepburn; and Robert Wallace. Endorsed by Alexander Shaw, and sworn before John Philp. Dated at Edinburgh.
