Folios 494-501.

To: The Local Government Act Office.

From: Messrs Gray, Johnston and Mounsey, Solicitors, 5 Raymond Buildings, Gray's Inn, London.

Subject Matter: Letter acknowledging receipt of a letter dated 10 June 1870, enclosing a copy of Robert Rawlinson's report [dated 8 June 1870]. They now enclose a statement of objections to the sanction of the scheme proposed for the outfall of the sewage at Ulverston [Lancashire]. They explain that they have read with surprise the statements in Rawlinson's report that 'the legal questions are to be tried in a Court of Law' and that 'the Law proceedings which have taken place, and which are now threatened against the completion of the outlet sewer are most vexatious and unnecessary'. The legal questions submitted on behalf of Mr Askew are said to have been intended for the decision of the Home Secretary, and not for the decision of a Court of Law. They submit that it can scarcely be supposed that Askew, the largest proprietor and ratepayer in the district, has any desire for 'vexatious or unnecessary litigation': - 'He desires to protect his property, which he considers will be seriously affected by the proposed outfall, and we observe that the report makes no allusion to it, although the principle objection for which the inquiry was applied for'.

[Folio 495 is Rawlinson's minute on Messrs Gray, Johnston and Mounsey's letter. He recommends that a copy of their statement of objections is sent to the Ulverston Sewer Authority for their remarks and explanations].
