Folios 90-92. Cabinet minutes of discussions concerning the trials of [Jacobite] prisoners, and fixing execution day. 114 prisoners 'who are either gentlemen and persons of note or who have distinguished themselves by an extraordinary degree of guilt or indecent behaviour' should be tried for high treason. The remaining 200 prisoners should 'draw lots' and one man in twenty should be tried. There is also some discussion of amendments to the law in Scotland allowing estates to be forfeited and whether some of the rebels should be tried in Scotland. Cabinet members present: Lord Chancellor; Lord President; Lord Chamberlain; Duke of Richmond; Earl of Chesterfield; Earl of Harrington; Mr Pelham; Duke of Newcastle; Attorney General; Lord Advocate of Scotland and the Solicitor General.
