Under section 4 of the Charities Act 1960, the Charity Commission was required to retain a register of all charities in England and Wales unless exempt under Schedule 2 of the same Act or by orders or regulations. As well as entering any qualifying organisation, the Commission has a duty to remove any organisation that ceases to operate or appears not to be a charity. Registration is regarded as a proof of charitable status of all purposes.
The Charity Commission inherited the function of determining charitable status from the Commissioners of Inland Revenue. Its decisions in this area can be appealed against in the High Court.
