Folio 72. Petition of Robert Maxwell, a prisoner in Carlisle gaol, to Newcastle. States that after the Battle of Falkirk he was employed by a commissary of the rebel [Jacobite] army to be his amanuensis [scribe, secretary] and remained in this post until the Battle of Culloden. Maxwell maintains that he never carried arms and did not take part in any of the battles. He surrendered to the Lord Justice Clerk at Edinburgh within the time allowed by the proclamation of Cumberland. He was then sent to Carlisle and his certificate of surrender should have been presented at his trial.
