Folios 113-118. Mr Dickenson's account of rebel [Jacobite] trials at Lancaster [Lancashire] assizes, from Mr Sharpe.
Trial of Mr Fowden, Manchester [Lancashire] magistrate, charged with: proclaiming the Pretender; directing people, including local militia, to join rebels; demanding whitesmiths make bullets; demanding horses and forage; drinking treasonable healths. Defence had 32 witnesses, including Mr Walley and Mr Bowker, to prove continued use of force against him by rebels. Found not guilty by jury.
Trial of Mr Ogden, from Oldham [Lancashire], charged with: drinking treasonable healths with Siddale, Maddox, and Bradshaw; wearing white cockade; recruiting for rebels in Oldham; marching with rebels. Prosecution witnesses were Thomas Dex soldier in John Lee's regiment, and Mr Shaw; third witness, Mr Billey, died before trial. Defence had 12 witnesses. Acquitted by jury.
Trial of Mr Darwen, accused spying for rebels. Case collapsed when two prosecution witnesses gave different testimony during trial: Thomas Hay said Darwen forced to spy; Ann Law swore she never met Darwen.
Trial of Mr Fletcher. Two prosecution witnesses saw him march with rebels through Wigan [Lancashire] with cockade and sword. Defence said he travelled to Manchester to collect his Papist neighbour's horses and carts. Witnesses attest he was not with rebels at all. Returned two days later, but without carts. Apprehended in Wigan hiding in chimney. Found not guilty by jury.
Walley discharged from his recognisance. William Cooper and Ralph Carter, taken at Carlisle [Cumberland] when rebels surrendered, discharged without entering into recognisance.
