Description

Prisoner name: David Leary.

Prisoner age: 16 years.

Prisoner occupation: Coach smith.

Court and date of trial: Central Criminal Court, December 1838.

Crime: Stealing in a dwelling house, 96 spoons and other articles to the value of £5 10s 0d. Victim Uzziel Emanuel.

Initial sentence: Ten years transportation.

Gaoler's report: 'Character not known'.

Annotated (Outcome): 'Nil'.

Petitioner(s): The prisoner's father Cornelius Leary, 14 Gees Court, Oxford Street, undersigned with statements from nine local people including the Prosecutor Uzziel Emanuel. The prisoner's mother Elizabeth Leary undersigned by seven supporters.

Grounds for clemency (Petition Details): The prisoner is young and this is his first offence; the prisoner was convicted on 'unsupported evidence'; the prisoner sustained a head injury as a child which lead to bouts of 'insanity'; the prisoner's aged mother is broken hearted.

Other papers: Character reference regarding the prisoner's father, from [Lord Radstock], Portland [Hall]. Extract from Middlesex Hospital Minute Book copied in letter from [D Lacing], Chaplain.

Additional Information: Prisoner sent to Fortitude convict hulk. Prisoner on board the Euryalus convict hulk. Prisoner tried with Dennis Burgin and John Keefe. Prisoner sailed to Hobart Town, [Van Diemens Land] on the Egyptian transport ship 9 April 1839.
