Description

Prisoner name: Donald Kennedy.

Prisoner occupation: Wood merchant and ship owner.

Court and date of trial: Edinburgh High Court, 3 December 1838.

Crime: Unlawfully shooting.

Initial sentence: Eight months imprisonment.

Annotated (Outcome): 'To stay where he is according to the sentence'. 'Two months of Sentence remitted'. 'The sentence cannot be further commuted'.

Petitioner(s): Two petitions from the prisoner. 15 Jury members.

Grounds for clemency (Petition Details): The prisoner did not intend to do serious harm to the victims and regrets the incident; the prisoner is of exemplary character; the prisoner's imprisonment will have an effect on his business and nearly 400 employees, which would be mitigated in part by a transfer to a gaol close-by; the prisoner would have been acquitted if tried in England; the jury was an Ipeciat one; the prisoner has served enough of his sentence to be released and be able to renew his employees contracts.

Additional Information: The prisoner came from Bogbain, Tain, Ross-shire, and also resided in Inverness area.
