Description

Prisoner name: Benjamin Castle.

Prisoner age: 19 years.

Court and date of trial: Old Bailey 9 May 1836.

Crime: Burglary. Victim, James Langan Maclayne (or James Langan McClen, or James Langham McCline).

Initial sentence: [Death] commuted to transportation for life.

Annotated (Outcome): Considered in Council 15 June 1836. In New South Wales, refuse (third application).

Petitioner(s): The prisoner's parents Thomas Castle and Sarah Castle undersigned by 15 supporters including the prosecutor. The prosecutor. Thomas Castle and Sarah (Mary) Castle undersigned by 35 supporters including the prosecutor, with two character references, one of which is undersigned with 16 names. The prisoner's father Thomas Castle of 6 Brook Green Place, Hammersmith, Middlesex.

Grounds for clemency (Petition Details): The prisoner was ensnared by others, never offended before and will not do so again; the prisoner has aged parents who need his support. The prisoner has behaved well in the colony.

Additional Information: The prisoner sailed on the Norfolk, bound for Sydney on 30 October 1836.
