Description

Folios 170-172. Letter from H Place, Collector, Sutton in Ashfield, [Mansfield Poor Law Union], to the Poor Law Board. He states that a vestry meeting has consented to adopting the new rating of small tenements act and as a new rate is wanted there is some difficulty in gaining time for the collection of the small rates now owing. On behalf of the overseers he asks if the small rates now owing can be collected as arrears from the present rate. Also can the rate be obtained under the act before closing and balancing the rate book now open, so as to be collecting the remains of a September rate and a January rate at the same time. Also is it compulsory for the overseers to obtain their next rate under the new act or can they obtain another rate under the old act?

Annotated: arrears should not be carried forward unless in cases where the same parties continue to be assessed, though the arrears in other cases are still recoverable. A new rate may be obtained before the old one is closed though it should not be made when there is any considerable amount of outstanding arrears. If it is made then the arrears of the former rate and the assessments under the new may be collected together. The overseers must proceed to rate the owners as soon as the vestry have resolved to do so.
