Folios 215a-215b.

To: The General Board of Health.

From: A Haymes, Clerk to the Local Board of Health, Leamington [Warwickshire].

Letter acknowledging receipt of a letter dated 16 February 1854, with reference to raising the necessary loan for the establishment of a Market in the town of Leamington on mortgage of the rates, under the Public Health Act 1848. Haymes states that 'if the expense of all works of a permanent nature are in all cases to be defrayed out of the Special District Rates, taking the 86 and 10-7 Sections literally, there seems to be no power in any case to raise money on mortgage of the General District Rate'. This, suggests Haymes, 'is evidently so absurd, and contrary to the general tenor of the 107 Section, which provides that the Local Board may mortgage and assign over the respective rates upon credit of which the sums are advanced, that it becomes a serious and important question whether that discretion to the Local Board, which I suggested, should be given under the above two Sections of the Public Health Act'. He submits that although the works to establish of a Market at Leamington would be permanent, they are od a 'general nature and of equal benefit to the town at large', and that 'the expense thereof should come out of the General District Rate'. Regardless of whether the loan is to be secured on the one rate or the other, Haymes enquires whether the General Board sees any preliminary objection to the required loan being raised, and requests to be informed as to 'what information generally they will require before giving their sanction thereto'.
