Description

Folios 159-175: Appeal 23; from the High Court of Admiralty concerning the vessel San Vincente (master Juan Bauptista Pellot), alleged to be Spanish.

History: sailing from Quebec to San Sebastian, laden with [whale] oil, fish. Taken by the Duke of Cornwall privateer, David Jenkins commanding.

Appellant or claimant: Juan Bauptista Pellet, on behalf of Don Vincente de Zavaletta, owner of the ship and goods.

Respondent: David Jenkins.

Respondent papers: case; appendix.

Sentence given 26 March 1760: Ship and goods condemned.

Discussed: whether the master and mate are not falsified by ship papers; whether the pass was duly obtained; whether false papers or concealment or destruction are not alone sufficient cause of confiscation; whether the ship is not French by adoption
