Folio 471.
To: The Home Secretary.
From: John Irwin, Clerk to the Local Board of Health, Denton [Lancashire].
Letter advising that the Denton Local Board has been summoned, as Surveyor of the Highways, to appear before the Magistrates of Ashton-under-Lyne, respecting the non-repair of a highway within the district of Denton, 'under the authority of an information laid by Mr Thomas Ludlain, Superintendent of Police for the district of Ashton'. Irwin explains that the highway in question is not repaired by the Board but by the occupiers of the land. He adds that the persons liable to the repairs are known and acknowledge their liability to them. Irwin states that interference with the authority of the Local Board by the police 'can only lead to difficulties'. He requests the opinion of the Home Secretary in respect of such interference.
