Description

Captured ship: Friends Goodwill (master John Doulman or Doleman, or as a Spanish prize, master Linio or Hinio Montate or Monto).

History: an English ship (120 tons, 6 guns) bound from Jamaica to London, laden with sugar and rum; separated from its covoy by bad weather, and taken on 21 October 1743 by the Spanish privateer Nuestra Senora de el Choro whose master Don Joseph Falle was then tricked by the English navigator into sailing the ship for the coast of England but arrived at Aberystwyth in Wales on 28 October 1743 amid further bad weather, where the ship was seized by customs officials.

Court Papers:

  • [CP 1-CP 4]: one examination and protest of the mate, deposition of some of the inhabitants of Aberystwyth, inventory of cargo seized;
  • [CP 5-CP 6]: two attestations and claims;
  • [CP 7]: release of the goods listed in the attached schedule;
  • [CP 8-CP 8D]: attestation with four exhibits;
  • [CP 9]: attestation of the Mayor of Aberystwyth about the Spanish crew taken as prisoners of war;
  • [CP10-CP 11]: allegation given by the residents of Abyerystwyth and docket;
  • [CP 12-CP 16]: attestation and claim of the master, appraisement of the condition and value of the ship and goods, commission, detailed account of all costs incurred in pursuing his claim to the vessel, prepared for his insurers;
  • [CP 17-CP 18]: two attestations of the mate;
  • [CP 19-CP 34]: fifteen depositions from the Spanish and English crews as well as the inhabitants of Aberystwyth and owners of the Friends' Goodwill, some with supporting exhibits;
  • [CP 35-CP 39]: standing and additional interrogatories, two examinations of the Spanish crew conducted at Plymouth.

Ship's Papers, numbered SP 1-SP 2.

  • SP 1: pass issued by Don Joseph Falle, allowing the Spanish prize crew safe passsage to San Sebastian;
  • SP 2: an English translation.

[Decision: restored paying salvage, 15 December 1743]
