Description

Captured ship: St Anniello e L'Anime del Purgatorio (master Giovanni Battista d'Accompora otherwise John Baptist D'Acompore).

History: a Neapolitan merchant ship (a tartan), bound from Gallipoli laden with oil [suspected to be destined for the Spanish army]; taken [on 28 June] 1742 in the Mediterranean by HMS Warwick (John Toller commanding), on a cruise in the Adriatic Sea with HMS Pembroke (Fitzroy Henry Lee commanding).

Court papers and exhibits (which may include some ship's pspers) are intermingled and all numbered as court papers:

  • [CP 1-CP 2]: claim by James Whitchurch on behalf of Peter Deharce, an English merchant resident in Leghorn [Livorno], and of Francisco Antonio Petti of Naples, both for the cargo; January 1744;
  • [CP 3]: affidavit of Fitzroy Henry Lee that he and Toller ransomed the ship and the most part of her cargo of olive oil to the master, for a small sum as being of little worth, and kept the master's brother as pledge, but they never received the ransom. The remaining part of the cargo of oil was sold at Ancona for only 2,838 zequins [zecchini]. The ship's papers were on board HMS Edinburgh at Portmouth, of which Lee was now captain; February 1745.
  • [CP 4]: attestation with four ship's papers and the ransom agreement or promissory note attached [4/1-4/5];
  • [CP 5-CP 6]: two sets of translations from Italian;
  • [CP 7-CP 8]: two releases of claims to a share in the prize money, June 1745.
  • [CP 9]: attestation of John Scott, secretary to Admiral Mathews, August 1745; with [9/1-9/6] six schedules of orders for the Mediterranean squadron in 1742;
  • [CP 10]: attestation of James Whitchurch merchant of London, with [10/1-10/6] 6 original Italian letters and papers, and translations, relating to the sale of the oil; brought into court August 1745;
  • [CP 11]: allegation, 30 November 1745
  • [CP 12]: copy of the London Gazette, number 8150, of 31 August - 4 September 1742, brought into court 30 November 1745;
  • [CP 13]: allegation on behalf of Francisco Antonio Petti of Naples and Jacopo Finocchietto of Leghorn, with 4 exhibits [13/1-13/4] relating to the purchase of the oil; brought into court 3 June 1746;
  • [CP 14]: claim by James Whitchurch on behalf of Peter Deharce, 3 June 1746;
  • [CP 15]: attestation that 2,828 zecchini were equivalent to £1,419 10s, June 1746;
  • [CP 16]: commision for examination of witnesses in Naples, with many papers attached [16/1-16/6 - with 16/1 including A-F and 16/2 including G-N], 3 June 1746; brought into court January 1747;
  • [CP 17]: translation of the papers returned by the Naples commission;
  • [CP 18]: allegation;
  • [CP 19-CP 20]: translation of proxy, and proxy for Petti;
  • [CP 21]: examinations taken at Leghorn and papers, with translations [21/-21/6]; brought into court January 1747;
  • [CP 22] commission for examination of witnesses in Leghorn [1746];
  • [CP 23]: attestation that Edward Jasper was not the agent of Fitzroy Henry Lee in relation to this capture, November 1746.
