Description

Prisoner name(s): Joseph Hill; George Hornsby; Sampson Hornsby.

Court and date of trial: Hill: Quarter Sessions for the County of Worcester held on 12 January 1825.

Crime: Hill: fowl stealing - prosecutor a tenant of Lord Plymouth; Hornsby sons, receiving fowls knowing them to be stolen.

Initial sentence: Hill: seven years transportation; George Hornsby 14 years transportation, Sampson seven years transportation.

Annotated (Outcome): Hill: removed to the penitentiary; 'Mr Peel sees no ground at present for a further interference in his favour'; 'pardon Hill'; reduce Hornsby to seven years transportation.

Petitioner(s): Hill: William Smith, Barrister, of Inkberrow, Worcestershire; Hornsby: five petitions from Maria Hornsby, mother of Shipston on Stour, Worcestershire.

Grounds for clemency (Petition Details): Hill: excellent character; met the Bennetts by chance and drank with them and they led him astray while he was intoxicated; no one spoke for him at his trial; Hornsbys: aged and poor widowed mother; good conduct during confinement; George Hornsby would be reemployed by Mr Gillett of Brails in Warwickshire if released; the Earl of Plymouth supports George Hornsby's case for mitigation; George has served four years.
