Description

Prisoner name(s): William Pain.

Prisoner age: 22.

Prisoner occupation: Apprentice Mason and Hellier to George Gidley.

Court and date of trial: Devon Lent Assizes held at Exeter in 1828.

Crime: Stealing two bullocks on the 10 August 1827.

Initial sentence: [Death] commuted to transportation for life.

Annotated (Outcome): In Van Diemen's Land. 'Mitigate' RP.

Petitioner(s): Three petitions from Josiah Pain (the prisoner's father) a house carpenter of 5 Navy Row, Morice Town, Devonport, [Devon]; one petition is undersigned by 34 inhabitants of the Parish of Stoke Damerel, Devon; Samuel Trehawke Kekewich of 16 Green Street, Grosvenor Square, [London].

Grounds for clemency (Petition Details): The prisoner was led to commit the crime by evil company; youth; has never committed a dishonest act before; the prisoner's master could not vouch for his good character at the trial because he was too sick to travel; the prisoner was an honest and obedient employee who was frequently trusted with his master's money and property.

The prisoner's father initially requested imprisonment for the prisoner. The prisoner was kept in the County Devon Gaol for seven months before his transportation.
