Description

Folios 706-707.

To: The Local Government Act Office.

From: R H Buse, Clerk to the Local Board of Health, Bideford [Devon].

Letter acknowledging receipt of a letter dated 7 June 1864. Buse provides additional information about a road referred to in a previous letter dated 6 June 1864. He states that two of the proprietors have written to him expressly refusing to make the road in question a highway and they intend to erect a gate across the entrance to exclude the general public. Buse adds that if the Board are authorised to light this road, then it is their understanding that they would be bound to adopt the same rule in regard to many other places 'to the great increase of the gas account'. He suggests that 'all the courts, alleys and rows which are now regarded as private property would be subject to the same rule, and in fact the Board would be fairly accused of partiality if they proceeded to light one without serving all alike'. Buse seeks guidance on the Board's power to light places of the kind in question and under what act the Board are considered to possess such power.
