Folios 610-611.

To: The Local Government Act Office.

From: Henry Whitworth, Clerk, The Board of Guardians for the Barton-upon-Irwell [Lancashire] Union, Patricroft [Lancashire].

A letter. Whitworth writes regarding a disagreement between the Board of Guardians and the Local Board for the for Barton [Lancashire], Eccles [Lancashire], Winton [Lancashire], and Monton [Lancashire] District over who should meet the cost of extending a sewer administered by the latter 200 yards so that it may drain a workhouse administered by the former.

Whitworth points out that in a former letter on the latter from the Office, they informed his that [ under the Local Government Act 1858] the Local Board had a responsibility to sewer side streets within their District just as much as they were responsible for the drainage of main or high streets. As the Board of Guardian do not want the construction of an additional 'main sewer' for the workhouse, but just a 'contributory sewer', Whithworth believes that the Local Board should be compelled under their legal obligation to meet the expense, with the Board of Guardians only contributing according to the rateable value of their property (the workhouse) as any other owner would for the work, rather than meeting extraordinary costs.
