Folio 294. Draft letter from the Poor Law Commission, to Thomas Day, Clerk to the Guardians of the Bromsgrove Poor Law Union, replying to their letter asking who are the proper parties to make complaints against the relations of poor people who they fail to maintain. They reply that in the cases that have come to court and are found in the reports, it would seem that orders under 43 Eliz c 2 have been made following complaints from the overseers and churchwardens, rather than the guardians. They refer to the case of [Regina v Toke 8 A&C 227]. However, 43 Eliz c 2 does not confine the power to make the application to any particular person, and it would seem that anyone acquainted with the facts and able to prove the chargeability could make the application.
