Folio 293. Letter from Thomas Day, Clerk to the Guardians of the Bromsgrove Poor Law Union, to the Poor Law Commission. He asks whether the guardians have powers to initiate proceedings, or order the overseers to do so, against relations of poor people who are liable under 43 Eliz [43 Eliz c 2] to maintain them. Alternatively, should the overseers make such a complaint?
Annotated: Mr Coode [George Coode, Assistant Secretary to the Poor Law Commission].
Annotated: from the cases that have come to court and are found in the reports, it seems that the complaint has been made by the overseers and churchwardens, and the Commission believes that the general practice is in accordance with those cases - see [Regina v Toke 8 A&C 227]. However, 43 Eliz c 2 does not confine the power to make the application to any particular person, and it would seem that anyone acquainted with the facts and able to prove the chargeability could make the application.
