Description

British New York Vice-Admiralty Court.

Captured ship: Swift (master James Gould).

History: an American merchant ship (sloop, 40 tons, 2 guns, 4 swivel guns, 11 men) bound from Baltimore, Maryland to St Eustatius, laden with tobacco; taken on 2 March 1779 south of Cape Hatteras, North Carolina in latitude 35°20'N, longitude 72°30'W by the loyalist privateer Norfolk's Revenge (George Mayer commanding), and brought into New York.

Court papers numbered CP 1-4:-

  • [CP 1]: attestation of papers brought in by the prize master Benedict Byrn, lieutenant, 12 March 1779;
  • [CP 2]: libel in Mayer v The sloop Swift and her cargo, 12 March 1779;
  • [CP 3]: monition, 12 March 1779;
  • [CP 4]: deposition of Daniel Spencer, 29 March 1779.

[Decision: condemned, if no response to the monition by 2 April 1779].

Ship's Papers numbered SP 1-5 (Maryland papers):-

  • SP 1: official ship's paper;
  • SP 2: log book;
  • SP 3-SP 5: ship's business papers, including sailing instructions from Baltimore to St Eustatius.

[Papers previously wrongly identified as Court papers: 1-7; Ship's papers: 8-12. (large pencil numbers): sorted and renumbered in 2025].
