Description

British New York Vice-Admiralty Court.

Captured ship: Morning Star (master Job Carr).

Capture history: an American merchant ship (sloop, 40 tons, 8 men) bound from Great Egg Harbor, New Jersey to Cap François, Saint Domingue, laden with flour, tobacco; taken on 8 January 1778 in latitude 32°30'N, longitude 69°W by HMS Experiment (Sir James Wallace commanding), and brought into New York.

Intended voyage: from the United States to the Caribbean Islands.

Court papers numbered CP 13:-

  • [CP 1]: libel in Advocate General at the relation of Wallace v The sloop Morning Star and her cargo, 28 January 1778;
  • [CP 2]: affidavit of papers [numbered 1-4] brought in by the prize master Richard Rouse, mate, 30 January 1778;
  • [CP 3]: deposition of Job Carr, 30 January 1778.

Ship's Papers numbered SP 1-4 (New Jersey papers) :-

  • SP 1: owners instructions, of Thomas Leaming, 27 December 1777;
  • SP 2: crew list and agreement, 23 December 1777;
  • SP 3: Leaming's deposition of US ownership, Burlington, 24 December 1777;
  • SP 4: clearance bond, Burlington, 24 December 1777.

[Papers previously wrongly identified as Court papers: 1-3; Ship's papers: 4-7 (large pencil numbers): sorted and renumbered in 2025].
