Description

British New York Vice-Admiralty Court.

Captured ship: Morning Star (master Abraham Van den Helm).

Capture history: a Dutch merchant ship (sloop, 60 tons, 7 men) bound from the island of St Martin, Danish West Indies, to New London, Connecticut, laden with salt, rum; taken on 1 September 1780 off Block Island, Rhode Island in latitude 40°N, by HMS America (Samuel Thompson commanding), HMS Royal Oak (William Swiney commanding), HMS Romulus (George Gayton commanding), and 13 other Royal Navy ships, and brought into New York.

Intended voyage: from the Caribbean Islands to the United States.

Court papers numbered CP 1-4:-

  • [CP 1]: affidavit of papers brought in by the prize master William Shillingford midshipman of HMS Romulus, 11 September 1780;
  • [CP 2]: libel in Advocate General at the relation of Swiney and others v The sloop Morning Star and her cargo, 11 September 1780;
  • [CP 3]: monition, 11 September 1780 ;
  • [CP 4]: deposition of Abraham Van Der Helm, a Dutch resident of St Martin, 12 September 1780.

[Decision: condemned, if no response to the monition by 2 October 1780].

  • SP 1: owners instructions, of Abraham Heyliger & Son, 5 August 1780.
