Description

British New York Vice-Admiralty Court.

Captured ship: Montgomery of Providence, Rhode Island (master Phineas Potter).

Capture history: an American merchant ship (sloop, 30 tons, 10 men) bound from Cap François, Saint Domingue to Boston, Massachusetts, laden with molasses, rum, salt coffee; taken on 6 or 8 February 1778 in latitude 37°40'N, longitude 72°23'W by HMS Experiment (Sir James Wallace commanding), and brought into New York.

Intended voyage: from the Caribbean Islands to the United States.

Court papers numbered CP 1-2:-

  • [CP 1]: affidavit of papers brought in by the prize master Eleazer Williams midshipman, 25 February 1778;
  • [CP 2]: libel in Advocate General at the relation of Wallace v The sloop Montgomery and her cargo, 27 February 1778.

Ship's Papers numbered SP 1-5 (Rhode Island papers):-

  • SP 1: clearance from Providence, 18 November 1777;
  • SP 2: detailed French certificate of sale of the cargo at Cap François, 19 January 1778;
  • SP 3: French receipt;
  • SP 4: rough account for return cargo;
  • SP 5: customs, Cap François, 27 January 1778.
