Description

British New York Vice-Admiralty Court.

Captured ship: Montague (master Pierre Girodroux).

Capture history: a French merchant ship (ship 'flute du roi', a French storeship, 300 tons, 2 guns, 2 swivels, 33 men) bound from Cap François, Saint Domingue in convoy to Chesapeake Bay, Virginia, laden with sugar, taffia, coffee, ironmongery, earthenware, wine, rum, cordage; taken on 11 January 1783 about 25 leagues off Cape Henry, Virginia by HMS Bonetta (Richard Keates commanding), HMS Diomede (Thomas Lenox Frederick commanding), HMS Quebec (Christopher Mason commanding), HMS Amphion (John Bazely commanding), and HMS Cyclops (Brabazon Christian commanding), and brought into New York.

Intended voyage: from the Caribbean Islands to the United States.

Court papers numbered CP 1-5:-

  • [CP 1]: affidavit of papers brought in by the prize master John Ramsay, mate of HMS Cyclops, 25 January 1783;
  • [CP 2]: libel in Advocate General at the relation of Keates v The ship Montague and her cargo, 25 January 1783;
  • [CP 3-CP4]: depositions of François Martin and Pierre Fournier, 29 January 1783;
  • [CP 5]: deposition of Pierre Girodroux, lieutenant de fregatte, 19 February 1783.

Ship's Papers numbered SP 1-9:-

  • SP 1-SP 6: factures or invoices of cargo;
  • SP 7: account of provisions received from the King's store;
  • SP 8: facture;
  • SP 9: certificate signed by 10 officers and men that rum and taffia were removed on the orders of the Comte de Kergariou-Locmaria, of the warship Sibylle, 17 December 1782
