Description

British New York Vice-Admiralty Court.

Captured ship: Molly (master Joseph Elliot).

Capture history: an American merchant ship (schooner, 50 tons, 10 men) bound from Maryland to St Eustatius, laden with tobacco, staves, shingles; taken on 27 March 1780 in latitude 32°48'N, longitude 69°10'W by the loyalist privateer Whalebone (John Brice commanding), and brought into New York.

Intended voyage: from the United States to the Caribbean Islands.

Court papers numbered CP 1-3:-

  • [CP 1]: affidavit of papers brought in by the prize master John Harford first lieutenant, 5 April 1780;
  • [CP 2]: libel in Brice v The schooner Molly and her cargo, 5 April 1780;
  • [CP 3]: monition, 5 April 1780.

[Decision: condemned, if no response to the monition by 26 April 1780].

Ship's Papers numbered SP 1-11: (Maryland papers)-

  • SP 1: clearance, 30 December 1779;
  • SP 2: owners' affidavit, 30 December 1779;
  • SP 3: clearance bond, 30 December 1779;
  • SP 4: crew list and agreement, 1779;
  • SP 5-SP 7: lists of goods to be purchased in St Eustatius, 13 March 1780;
  • SP 8: invoice of cargo consigned to William Smith, St Eustatius, Cambridge, Maryland, 13 March 1780, problably enclossed in SP 9;
  • SP 9: letter from Archibald Patison & Co, owners, Cambridge, Maryland, to William Smith, St Eustatius, 13 March 1780;
  • SP 10: owners instructions, 13 March 1780;
  • SP 11: wrapper.
