Description

British New York Vice-Admiralty Court.

Captured ship: Hope (master John Prole).

Capture history: an American merchant ship with a letter of marque (ship, 70 tons, 10 guns, 30 men) bound from Philadelphia, Pennsylvania to St Thomas, Danish West Indies, laden with flour, tobacco, and staves; taken on 18 December 1782 near Cape Delaware by HMS Astra (Matthew Squire commanding), HMS Quebec (Christopher Mason commanding), HMS Diomede (Thomas Lennon Frederick commanding), [and brought into New York].

Intended voyage: from the United States to the Caribbean Islands.

Court papers numbered CP 1-4:-

  • [CP 1]: affidavit of papers (numbered 1-12) brought in by the prize master William Gibson, surgeon of HMS Astra, 26 December 1782;
  • [CP 2]: libel in Advocate General at the relation of Squire v The ship Hope and her cargo, 27 December 1782;
  • [CP 3]: monition, 27 December 1782;
  • [CP 4]: deposition of James Smith of Philadelphia, mate, 3 January 1783.

[Decision: condemned, if no response to the monition by 17 January 1783].

Ship's Papers numbered SP 1-12 (Pennsylvania papers):-

  • SP 1: ships register, 13 March 1781;
  • SP 2-SP 3: invoices of cargo, shipped by Andrew and James Caldwell, and by Thomas Kean;
  • SP 4-SP 7: bills of lading;
  • SP 8: printed privateer commission, with a description of the master on the reverse, 9 December 1782;
  • SP 9: owners instructions of Andrew and James Caldwell, Philadelphia, 10 December 1782;
  • SP 10: clearance, with a description of the master, 8 December 1782;
  • SP 11: invoices of sundries, shipped by Andrew and James Caldwell;
  • SP 12: crew list and agreement (two of the crew, described as black boys, received no pay - enslaved sailors?), 13 December 1782.
