Description

British New York Vice-Admiralty Court.

Captured ship: General Gadsden of Boston (commander John Harn or Horn).

History: an American privateer with a letter of marque (120 or 157 tons, 16 or 20 guns, 87 men) bound from Boston on a cruise; taken on 5 or 6 September 1778 in latitude 39°30'N, longitude 73°W by HMS Daphne (St John Chinnery commanding), and brought into New York.

Court papers numbered CP 1-4:-

  • [CP 1]: libel in Advocate General at the relation of Chinnery v The privateer brig General Gadsden, 11 September 1778;
  • [CP 2]: wrapper of the affidavit of papers- the actual affidavit is missing];
  • [CP 3-CP 4]: two depositions of John Horn of Old York, Massachusetts, and of Henry Brunson of Maryland, second lieutenant , 19 September 1778.

Ship's Papers numbered SP 1:-

  • SP 1: printed privateer commission, 18 August 1778; in a very strange format, incorporating a repair using blue paper extending under the seal.

[Papers previously wrongly identified as Court papers: 1-4; Ship's papers: 5-6 (large pencil numbers): sorted and renumbered in 2025].
